Toki welcomes you to its website (tokitracker.com) and its macOS application "Toki." These terms cover access to the Site, the App, proprietary software, content, documentation, and related services (collectively the "Services"). Please read these terms carefully before use.

Section 1 - Service Terms and Limitations

1.1 Proprietary Rights

All content on the Site and App is copyright-protected and exclusively owned by Toki. You may display or download portions for non-commercial personal use only. Redistribution or republication of copyrighted material requires express written permission.

1.2 Grant of Limited License

Access is licensed, not sold. Toki grants you a revocable, non-exclusive, non-transferable license to access and use the Services, App, and Site upon registration. All content is owned by Toki and licensed, not sold.

1.3 Use of the App

Use of the App is conditioned on acceptance of these terms. You may not:

  • Decompile or reverse engineer the App
  • Modify or create derivative works
  • Use it to provide commercial services to third parties
  • Transmit its functionality over the internet
  • Sell, distribute, rent, or sublicense the App to third parties
  • Use App components for other applications

1.4 User Representations

You warrant that you will maintain the security and integrity of messages and content transmitted through the Services, comply with these terms, and comply with all applicable laws and regulations.

1.5 User Restrictions

You may not distribute, display, rent, lease, or exploit the Content in whole or in part in ways inconsistent with copyright protection and fair use principles.

Section 2 - General Disclaimers

2.1 General Disclaimer

The Site and App are provided "as is." Toki makes no representations or warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

2.2 Links to Third Party Services

The Site and App may link to third-party websites. Access to linked sites is at your own risk; Toki is not responsible for their accuracy, availability, or reliability.

Section 3 - Indemnification

You agree to indemnify, defend, and hold harmless Toki, its officers, directors, employees, agents, and licensors from all losses, expenses, damages, and costs (including attorney's fees) resulting from any violation of this Agreement or related account activity.

Section 4 - Waiver and Release

You agree that Toki and its officers, directors, employees, agents, and licensors shall have no liability under any theory of liability in connection with your use of the Site, App, Service, or Content. You release and forever waive all claims against Toki for losses or damages sustained through use.

Section 5 - Liability Limitation

Toki will not be liable under any theory of law for any indirect, incidental, punitive, or consequential damages arising from use or inability to use the Site or App, or from reliance on information presented.

Section 6 - Payment Terms

Toki is available as a one-time purchase through the Mac App Store. By completing your purchase, you receive a permanent license to use the version of Toki you purchased, including any future updates within the same major version. There are no recurring charges or subscriptions. All purchases are processed by Apple and are subject to Apple's standard App Store purchase and refund policies.

Section 8 - Governing Law

This Agreement is governed by the laws of Kosovo. Any legal proceedings between Toki and users shall be brought exclusively in a court of competent jurisdiction in Kosovo.
